Cooper’s eSports Gaming Center
Guest Terms, Facility Rules, Assumption of Risk, and Waiver of Liability
Location: Cooper’s eSports Gaming Center, Irvine, California
Please read this agreement carefully before entering, creating an account, using any computer, console, controller, headset, gaming station, software, game, online account, website, mobile app, tournament system, or participating in any activity, party, camp, tournament, event, or private booking at Cooper’s eSports Gaming Center.
By creating a GGLeap account, checking in, signing in, clicking “I Agree,” using the facility, using any PC or console, participating in any event, or otherwise using Cooper’s eSports Gaming Center services, you agree to these Guest Terms, Facility Rules, Assumption of Risk, Privacy Policy and Waiver of Liability.
If you do not agree, do not use the facility, equipment, website, app, PCs, consoles, games, or services.
1. Required Account Creation and Acceptance of Terms
Every guest must create or have an active GGLeap account and must accept these Terms before playing or using any Cooper’s eSports Gaming Center equipment or services.
This requirement applies to all guests, including but not limited to:
- Walk-in guests
- PC players
- Console players
- Groups
- Parties
- Camps
- Tournament participants
- Private event guests
- Spectators who participate in any activity or use any equipment
No guest may play or use facility equipment unless the guest has completed the required account setup and accepted these Terms.
For minor guests, a parent or legal guardian must complete the required parent/legal guardian authorization process before the minor may participate, unless management has approved a temporary exception in writing.
2. Assumption of Risk
Participation in gaming, esports, LAN center activities, console play, PC use, tournaments, camps, parties, private events, and related activities involves certain inherent and unavoidable risks.
These risks may include, but are not limited to:
- Eye strain, headaches, fatigue, or dizziness
- Wrist, hand, neck, shoulder, or back discomfort
- Repetitive motion injuries or aggravation of pre-existing conditions
- Photosensitivity, seizure-related concerns, or reactions to flashing lights or visual effects
- Emotional stress, frustration, or anxiety related to gameplay or competition
- Slips, trips, falls, or collisions while moving through the facility
- Injuries or property damage related to use or misuse of gaming equipment, chairs, desks, controllers, headsets, cords, cables, or other facility property
- Exposure to online communications, multiplayer interactions, user-generated content, competitive conduct, mature themes, violence, language, or game content that may not be suitable for all ages
By participating, you voluntarily assume all risks associated with your visit, participation, and use of the facility, services, games, and equipment.
3. Health and Safety Advisory
Guests are responsible for monitoring their own physical and mental condition during gameplay.
Guests should take regular breaks and immediately stop playing if they experience discomfort, including but not limited to eye strain, headache, dizziness, nausea, wrist pain, back pain, emotional distress, or other symptoms.
Guests with a history of seizures, photosensitivity, migraines, motion sickness, repetitive motion injuries, or other medical concerns should consult a medical professional before participating in gaming or esports activities.
Cooper’s eSports Gaming Center does not provide medical advice, medical supervision, childcare, or health monitoring.
4. Game Content and Age Ratings
Some games may contain violence, mature themes, online interactions, strong language, or other content that may not be appropriate for all guests.
Guests and parents/legal guardians are responsible for reviewing and approving the games they or their children play.
Cooper’s eSports Gaming Center does not guarantee that every game, player interaction, online communication, or user-generated content will be suitable for every age or preference.
Management may restrict certain games, accounts, or content at its discretion.
5. Guest Conduct Rules
All guests must follow staff instructions, posted rules, and facility policies.
The following conduct is prohibited:
- Harassment, bullying, threats, intimidation, hate speech, or abusive language
- Fighting, roughhousing, unsafe behavior, or disruptive conduct
- Cheating, hacking, exploiting, account stealing, account sharing, or bypassing security controls
- Tampering with PCs, consoles, cables, peripherals, network equipment, software, settings, or facility systems
- Downloading unauthorized software, malware, cheats, scripts, hacks, or illegal content
- Accessing inappropriate websites or content
- Damaging, misusing, moving, removing, or altering facility equipment or property
- Food or drink misuse near equipment
- Theft or attempted theft
- Use of illegal substances, smoking, vaping, or alcohol unless expressly permitted by management and applicable law
- Any conduct that management determines may create a safety risk, business disruption, or negative guest experience
Cooper’s eSports Gaming Center may refuse service, suspend access, remove a guest, cancel a booking, or terminate play without refund for violation of these Terms or facility rules.
6. Equipment Use and Damage Responsibility
Guests must use all facility equipment properly and responsibly.
This includes, but is not limited to:
- PCs
- Consoles
- Monitors
- Keyboards
- Mice
- Controllers
- Headsets
- Chairs
- Tables
- Cables
- Network equipment
- Gaming accounts
- Software and accessories
Guests are responsible for any damage caused by negligence, misuse, intentional conduct, reckless conduct, rule violations, or failure to follow staff instructions.
For minor guests, the parent or legal guardian is responsible for damage caused by the minor to the fullest extent permitted by law.
Cooper’s eSports Gaming Center may charge the responsible guest, parent, guardian, or account holder for repair, replacement, cleaning, labor, administrative costs, or related expenses caused by damage or misuse.
7. Personal Property
Guests are responsible for their own personal property.
Cooper’s eSports Gaming Center is not responsible for lost, stolen, damaged, or misplaced items, including but not limited to phones, wallets, bags, clothing, personal peripherals, gaming devices, controllers, laptops, or other personal belongings, except to the extent liability cannot be waived under California law.
Guests who bring their own peripherals or equipment do so at their own risk.
8. Release and Waiver of Liability
To the fullest extent permitted by California law, you release, waive, and agree not to bring claims against Cooper’s eSports Gaming Center, its owners, officers, directors, employees, contractors, affiliates, landlords, sponsors, vendors, agents, representatives, successors, and assigns for claims arising out of or related to your participation, visit, use of the facility, use of equipment, use of games or software, use of online services, or participation in any activity, event, party, tournament, camp, or booking, including claims arising from ordinary negligence.
This release applies to claims for personal injury, property damage, economic loss, emotional distress, illness, discomfort, loss of data, loss of personal property, or other damages arising out of or related to participation or use of the facility or services.
This agreement does not release or waive claims that cannot be released or waived under California law, including claims arising from gross negligence, willful misconduct, fraud, intentional acts, or violations of law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Cooper’s eSports Gaming Center, its owners, officers, directors, employees, contractors, affiliates, landlords, sponsors, vendors, agents, representatives, successors, and assigns from and against any third-party claims, demands, damages, losses, liabilities, fines, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your violation of these Terms
- Your misuse of the facility, services, equipment, software, games, or accounts
- Your violation of law or the rights of another person
- Your misconduct, negligence, intentional conduct, or reckless conduct
- Damage to property caused by you
- Claims brought by another guest, participant, or third party arising from your actions
For minor guests, the parent or legal guardian agrees to this indemnification to the fullest extent permitted by law.
10. Events, Parties, Camps, and Tournaments
Events, parties, camps, tournaments, and private bookings may be subject to additional rules, schedules, registration requirements, payment terms, cancellation policies, supervision requirements, tournament rules, and conduct standards.
Guests must comply with all event-specific rules.
Cooper’s eSports Gaming Center may change tournament rules, schedules, brackets, formats, prizes, equipment assignments, or event procedures when necessary for fairness, safety, operations, or business needs.
11. Website, App, Account, and Online Services
The Cooper’s eSports Gaming Center website, app, account systems, online services, booking systems, and digital materials are provided on an “as is” and “as available” basis.
Cooper’s eSports Gaming Center does not guarantee uninterrupted access, error-free operation, availability of specific games, availability of specific computers or consoles, online service uptime, account access, game server access, internet availability, or compatibility with every user preference.
Guests may not copy, scrape, reverse engineer, interfere with, overload, misuse, or attempt unauthorized access to Cooper’s eSports Gaming Center systems, accounts, software, network, website, or app.
12. Privacy and Data Collection
Cooper’s eSports Gaming Center may collect information needed to create accounts, process bookings, manage check-ins, communicate with guests, operate events, enforce safety rules, protect equipment, process payments through authorized payment processors, and provide services.
Cooper’s eSports Gaming Center does not request Social Security numbers, driver’s license numbers, or bank account information through general guest account creation unless separately required for a specific transaction, legal requirement, or authorized payment process.
Payment information should be handled through approved payment processors or separate written payment authorization forms.
Use of the website, app, and online services is also subject to Cooper’s eSports Gaming Center’s Privacy Policy.
13. Photos and Video
Cooper’s eSports Gaming Center may use security cameras for safety, security, loss prevention, operations, and incident review.
Marketing photos, videos, testimonials, or promotional content may require separate consent, especially for minors.
Parents/legal guardians should complete any required media release before a minor is photographed or recorded for promotional use.
14. Right to Refuse Service and Remove Guests
Cooper’s eSports Gaming Center reserves the right to refuse service, suspend access, cancel play, remove guests, restrict accounts, or deny future access when management determines that a guest has violated these Terms, created a safety concern, disrupted operations, damaged property, harassed others, or acted in a way that may negatively affect the business, staff, guests, or property.
Refunds are not required when removal or suspension is due to rule violations, unsafe behavior, misconduct, or misuse of the facility.
15. Governing Law and Venue
These Terms are governed by the laws of the State of California.
Any dispute arising out of or related to these Terms, the facility, services, account use, or participation at Cooper’s eSports Gaming Center shall be handled in the appropriate courts located in Orange County, California, unless applicable law requires otherwise.
16. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect to the fullest extent permitted by law.
17. Acknowledgment
By creating an account, checking in, clicking “I Agree,” using any PC or console, participating in any activity, or using Cooper’s eSports Gaming Center services, I confirm that:
- I have read these Terms
- I understand these Terms
- I agree to follow all facility rules
- I understand that gaming and esports activities involve risks
- I voluntarily assume those risks
- I agree to the release, waiver, and indemnity provisions to the fullest extent permitted by California law
- I understand that failure to follow these Terms may result in removal, suspension, denial of service, and loss of access without refund
